Mediation Tips For Successful Structured Settlements

  • Contact your structured settlement consultant during negotiations and before the mediation. Educating your clients about structured settlements requires time, and introducing the consultant to your client early in the process allows Gleason Settlements to explain the settlement options, the pros and cons of each, and answer all questions.

  • Inform the mediator that you and/or your client may want a structured settlement as part of the settlement.

  • Provide the mediator with “How to Achieve a Successful Structured Settlement.” While most attorneys are familiar with structured settlements, not all attorneys and mediators understand them.

  • Ensure that all necessary provisions and required language are incorporated into the mediation agreement.
    Here is sample language to include:

    “Plaintiff and their legal counsel will have the right to receive periodic payments using an annuity and/or market-based structured settlement programs. Such program(s) will be funded by the defendant or their insurance carrier via wire transfer or check to the appropriate assignment company in exchange for a fully executed Settlement and Release Agreement and an Assignment document mutually agreed by the parties. Plaintiff and/or plaintiff’s legal counsel may work with the settlement consultant of their choice.”
